JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Muzafarpur Town P.S. Case No. 446 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 38(1), 38(2), 47 and 48 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of liquor from the house of one Gita Devi.

The learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The aforesaid Gita Devi from whose house the liquor

Patna High Court Cr.Misc. No.60556 of 2017 (2) dt.21-12-2017 2/2 has been recovered, has already been granted bail by a coordinate Bench of this Court, a copy of which is annexed at Annexure-2 series. The petitioner is in custody since 13.10.2017. Considering the nature of accusation and also the fact that the main accused has already been granted bail, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 446 of 2017.
