2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 103(1), 308(5) and 3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, the informant alleged that on 19.05.2025 at about 07:40 P.M., he received information that three accused persons had fired gunshots at his brother. Upon reaching the spot, he found his brother lying on the ground with blood oozing from his body. He was subsequently declared dead.
4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. During the course of investigation, the petitioner's name surfaced only in the
Patna High Court CR. MISC. No.67251 of 2025(3) dt.24-11-2025 2/2 confessional statement of co-accused Manish Kumar @ Vicky Kumar. The petitioner is merely alleged to be a 'liner' and is not stated to have participated in the actual commission of the alleged offence. The petitioner is under custody since 05.06.2025..
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of I/C J.M.-1st Class, Patna City in connection with Khajekala P.
