JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 363 of 2006, registered for the offences punishable under Section 392 of the Indian Penal Code.

As per complaint there is allegation of assaulting and snatching money against the petitioners.

Submission of the learned counsel for the petitioners is that as a matter of fact, one boy of the family of the petitioner

Patna High Court CR. MISC. No.68911 of 2019(2) dt.18-11-2019 2/2 no. 1 was traceless for that they inquired from the complainant and others for that he has made accused on false allegation. There is no chance of tampering with the evidence. Petitioners having no criminal antecedent.

On the other hand, learned A.P.P has opposed the prayer of bail.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M. Birpur, in connection with Complaint Case No.-363 of 2006, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned with condition that they shall co-operate in disposal of the complaint case..
