====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the allegation is under Section 302, 304B, 120B, 490 and 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.05.2022 and is a person with clean antecedent.

The informant alleges that on 15.03.2022 at about 9.00 PM, he got an information that dead body of his sister was lying in a bamboo-bush, accordingly, he reached the place of occurrence where he saw the body of his sister lying in a pool of blood with throat slit.

No.68116 of 2022(2) dt.29-04-2023 2/2 The learned counsel for the petitioner submits that petitioner has bee falsely implicated in the present case, it is next submitted that petitioner being uncle (fufa) of the husband of the deceased, he has been implicated in the present case where there is no specific allegation against him.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kishanganj P.S. Case No. 114 of 2022.
