This application for grant of regular bail arises out of Kursakanta (Sonamani Godam) P.S. Case No. 157 of 2018 registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.
The petitioner is the husband of the deceased. Learned counsel appearing on behalf of the petitioner has submitted that it is evident from the First Information Report itself that marriage was solemnized nearly 15 years before the date of occurrence. There is allegation in the First Information Report of demand of dowry also. The deceased died of asphyxia due to drowning in a nearby pond. It is the case of the petitioner that he is in custody since 23.10.2018. The charge-sheet has been submitted for the offence punishable under Section 306 of the Indian Penal Code. Patna High Court CR. MISC. No.62765 of 2019(4) dt.16-03-2020 2/2 appears to be correct in his submission that there is no material to suggest in abetment on the part of the petitioner in commission of suicide.
Be that as it may, in the facts and circumstances of the case, case for grant of regular bail is made out. This application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Araria, in Kursakanta (Sonamani Godam) P.S. Case No. 157 of 2018.
