JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Vibhutipur/Bibhutipur P.S. Case No. 93 of 2018 registered for the offence punishable under Section 135 of the Electricity Act, 2003.

As per FIR there is allegation against the petitioner that he committed theft by cutting wire of 10 metres and caused loss to the tune of Rs.24,376/- to the North Bihar Power Distribution Company Ltd.

Submission of learned counsel for the petitioner is that he is a genuine consumer of N.B.P.D.C.L. he has falsely been implicated in this case and petitioner demanded video recording of above theft but the same was not supplied to him

Patna High Court CR. MISC. No.62747 of 2019(3) dt.17-10-2019 2/2 saying that due to technical fault it has become corrupt. Heard learned APP. None appears on behalf of North Bihar Power Distribution Co. Ltd. though name of learned counsel is appearing in the cause list.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Rosera, Samastipur, in connection with Bibhutipur/Vibhutipur P.S. Case No. 93 of 2018, G.R. No. 302 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
