This writ petition under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for quashing of the FIR of Patliputra P.S. Case No. 303 of 2017 dated 11.09.2017 registered under Sections 498A and 494 of the Indian Penal Code.

On perusal of the FIR, as contained in Annexure-1 to the writ petition, I find that ingredients of a cognizable offence

Patna High Court Cr. WJC No.365 of 2018(3) dt.04-01-2019 2/2 punishable under Section 498A Indian Penal code are clearly attracted.

In that view of the matter, institution of the FIR or investigation pursuant to institution of the FIR cannot be held to be bad.

Accordingly, the writ petition, being devoid of any merit, is dismissed.
