2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 115(2), 126(2), 109(1), 103(1), 117(2) and 352 of the BNS and Sections 25(1-b)(a), 26 and 35 of the Arms Act.

3. The allegation against the petitioner is that he along with other accused persons, armed with weapon, came at the house of informant and started abusing him and his family members. It is further alleged that co-accused, Gauri Shankar fired with pistol on the body of informant's father. Co-accused Prahlad Kumar and Chandan Kumar assaulted with danda and rod on the hand and head of informant's brother, Dilkhush Kumar.

4. Learned counsel for the petitioner submits that petitioner is only alleged to be member of the unlawful assembly. Specific accusation of firing and assault is against coaccused persons. Similarly situated co-accused, Bhagirath Kumar and Shivam Kumar have already been granted regular bail by a co-ordinate Bench of this Court vide order dated 15.11.2025 passed in Cr. Misc. No. 59112 of 2025. Petitioner is in custody since 15.06.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Deepnagar P. S. Case No. 186 of 2025.
