JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-11-2017 Heard learned counsel for the petitioners and counsel appearing on behalf of the State as well as Accountant General. Ms. Narmata Mishra has drawn attention of the court to the supplementary counter affidavit filed on 21.11.2017. She submits that the office of the Accountant General has already filed supplementary counter affidavit and nothing is pending at the level of the office of the Accountant General.

Needful is required to be done by the State authorities.

In view of the above, the order dated 13.10.2017 is modified to the extent that liability to pay a cost of Rs. 5000/- is not applicable so far as the Accountant General is concerned, the State authorities have not filed counter affidavit, they are liable to pay cost in terms of order dated 17.10.2017.
