This application has been filed on behalf of the petitioner for reinstating him at his own position/Rank as he was, and further for quashing the order passed by the DIG, Begusarai Zone, Begusarai vide Memo No. 1372 dated 30.09.2022 which has been communicated to the petitioner through Begusarai District Order No. 1913 of 2022 contained in Memo No. 2989 dated 19.10.2022 through the Office of the Superintendent of Police, Begusarai by which the appeal filed

Patna High Court CWJC No.18023 of 2023(2) dt.09-09-2025 2/2 by the petitioner in connection with Departmental Enquiry Proceeding bearing number 53 /2021 has been rejected and the penalty has been imposed upon the petitioner and his designation was reduced from Sub Inspector of Police to Assistant Sub-Inspector of Police.

3. Though this application has been filed on behalf of the petitioner challenging the order dated 30.09.2022 but no appeal has been filed by the petitioner before the appellate authority before approaching this Court.

4. In view of the above, this application is permitted to be withdrawn by the petitioner with a liberty to the petitioner to prefer an statutory appeal before the appropriate authority within 30 days from today. If such an appeal is filed then the authority concerned will consider the same in accordance with law and will pass a reasoned order within further two months of its filing.

5. With the aforesaid direction, this application is disposed of.
