The petitioner is apprehending his arrest in connection with Bibhutipur P.S. Case No. 72 of 2017 for the offence registered under Sections 302 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner in the instant case. The petitioner has no criminal antecedent. It is further submitted that the other co-accused person who was named in the FIR has already been extended the privilege of bail in Cr.Misc. No. 31780 of 2017 vide order dated 13.07.2017. Considering the aforementioned facts and circumstances and that the petitioner has a clean antecedent, let

Case No. 72 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
