JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2023 The present writ petition has been filed seeking the following reliefs:- "1) For quashing the order dated 26/06/2019 (Annexure-1) passed by the collector, Banka (Respondent no. 5), whereby and whereunder 1(one) Acre land of Mouza Panjwara, Thana no. 354, Khata no. 147, Khesra no. 763 has been ordered to transfer to Home Department, Govt. of Bihar construction of Police Station building free of cost.

Patna High Court CWJC No.16887 of 2022(4) dt.15-02-2023 2/3 ii) For direction commanding the respondents to stop construction of Police Station Building upon the play ground of Govt. aided High School, Panjwara and Govt. Middle School forthwith and further prays to restrain the respondents from making any construction over the land of the school which is only place for the children of the schools to play."

In pursuance to the order of this Court, the District Magistrate, Banka, has filed a counter affidavit, wherein it has been admitted that the police station building is being constructed on the land of the Government Aided High School, Panjwara and Government Middle School, hence it has been stated in the counter affidavit that process has been initiated for withdrawal of the proposal for construction of police station, Panjwara on the said land as also the work of construction of the police station in question has been stopped.

In view of the aforesaid, nothing survives for further consideration in the present petition, hence the present writ petition stands disposed off,

Patna High Court CWJC No.16887 of 2022(4) dt.15-02-2023 3/3 however, with a direction to the District Magistrate, Banka and other district authorities to immediately remove the construction already carried out over the land in question, pertaining to the proposed police station.
