ANJANA MISHRA ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner is in custody since 16.05.2017 in connection with L.N.M.U. P.S. Case No.111 of 2017, registered under Sections 20 (B), 22 & 24 of the Narcotic Drugs and Psychotropic Substances Act.
The learned counsel for the petitioner submits that the alleged recovery were not from the conscious possession of the petitioner but from the hut and the quantities are a little, i.e., 130 gram and 1 k.g. which is meager quantity as per the Act. It is further submitted that the petitioner has no concern with the illegal business of ganja and the hut was not in the exclusive possession of the petitioner. In view of the aforementioned facts and circumstances and also the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, Darbhanga, in connection with L.N.M.U. P.S. Case No.111 of 2017 giving rise to G.O. Case No.09 of 2017.
