2. The petitioner seeks regular bail in connection with Thakurganj P.S. Case No. 165 of 2023 registered for the offence under Sections 419, 420, 188, 304, 120B/34 of the Indian Penal Code and Sections 40, 41 (1 and 2) of the Clinical Establishment Act.
3. The allegation against the petitioner is of running an illegal hospital in which a patient has died. The matter was enquired by the District Administration and thereafter an FIR was registered. The petitioner is in custody since 18.06.2025.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. He further submits that there is a delay in the registration of the FIR
Patna High Court CR. MISC. No.67334 of 2025(3) dt.10-12-2025 2/2 and the petitioner is not involved in the crime.
5. Learned A.P.P. for the State, Mr. Jharkhandi Upadhyay has vehemently opposed the prayer for bail and has submitted that the petitioner is a quack who along with others is involved in running a hospital without doctors in which the deceased died.
6. Considering the aforesaid facts and circumstances of the case, this Court is not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail stands rejected.
