ANJANA MISHRA ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.09.2017 in connection with Majorganj P.S. Case No.159 of 2016 registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. but only on the basis of the confessional statement made before the police by one coaccused Prem Ranjan Singh, that his name has surfaced. He further submits that other similarly situated persons have been extended the privilege of bail in Cr.Misc. No.51010 of 2016, Cr.Misc. No.49360 of 2016, Cr.Misc. No.4165 of 2017

Patna High Court Cr.Misc. No.58827 of 2017 (2) dt.13-12-2017 2/2 and Cr. Misc. No.39923 of 2017, vide orders dated 22.12.2016, 10.01.2017, 28.02.2017 and 22.08.2017. Taking into consideration the aforementioned facts and circumstances and that the petitioner is involved in one another case under Section 498A of the I.P.C., let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Majorganj P.S. Case No.159 of 2016.
