ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.08.2019 in connection with Cheria Bariyapur P.S. Case No. 119 of 2019 registered for the offence under Section 30(a) of the Bihar prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were from the Bamboo hut which is being as the 'Bushaghar' of the petitioner and not from the conscious possession of the petitioner. The petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.62458 of 2019(2) dt.16-10-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional Sessions Judge II Begusaraicum-Special Judge, Bihar Prohibtion and Excise Act, 2016, Begusarai in connection with Cheria Bariyapur P.S. Case No. 119 of 2019.
