The petitioner seeks bail in a case registered under Section 25(1-b)a/26/35 of the Arms Act.

Allegedly, a loaded country-made pistol is recovered from possession of the petitioner.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24-03-2019. Charge sheet has already been submitted. A loaded country-made pistol is alleged to have been recovered. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioner is

Patna High Court CR. MISC. No.63139 of 2019(2) dt.17-10-2019 2/2 named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Patna Junction in connection with Bakhtiyarpur G.R.P.S. Case No. 45 of 2019.
