Petitioner seeks bail in connection with Chapra Mufassil P.S. Case No. 376 of 2017 registered for the offence punishable under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity and there is no eye witness of the occurrence except the informant. Petitioner is a man of clean antecedent and he is in custody since 19.02.2018.

Learned Addl. P.P. appearing for the State opposes the prayer bail and submits that there is direct allegation against this petitioner of firing on the head of informant's son. Considering the nature of allegations levelled, the

No.36990 of 2018(5) dt.17-07-2018 2/2 materials available on record and the submissions advanced on behalf of the parties, this Court is not inclined to grant bail to the petitioner. His prayer for bail is, therefore, rejected. However, petitioner may renew his prayer for bail after framing of charge.
