The petitioner apprehends arrest in connection with Dawath P.S.Case No.127 of 2014 registered for an offence under sections 395, 397 and 412 of the IPC.
It has been submitted that the present case was registered against 7-8 unknown miscreants for the offence under Sections 395 and 397 of the IPC. The stolen truck was subsequently recovered for which Arwal P.S.Case No.261 of 2014 was registered for the offence under Sections 414, 467, 468, 471 and 120B of the IPC. In the said case, the driver of the truck confessed his complicity in the above crime and also disclosed the name of this petitioner and other co-accuseds. In the said Arwal P.S.Case No.261 of 2014, this petitioner has been allowed bail by one of the
Patna High Court Cr.Misc. No.60379 of 2017 (2) dt.01-02-2018 2/2 coordinate Bench of this Court in Cr.Misc.No.16244 of 2015 . However, learned APP opposed the submissions. Considering the fact that the name of this petitioner appeared in the confessional statement of co-accused Vikash Sharma @ Babloo who has already been allowed anticipatory bail by a coordinate Bench of this Court and except that there is nothing against this petitioner, the prayer for anticipatory bail is allowed. Let the above named petitioner in the even of his arrest or surrender before the court below within six weeks from today be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Bikramganj, Rohtas in connection with Dawath P.S.Case No.127 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
