JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Excise Case No. 372 of 2018 (Durgawati P.S. Case No. 146 of 2018) for the offence under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a) and 38(i) of the Bihar Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is in custody since 22.04.2018. He submits that similarly circumstanced other co-accused, namely, Ritesh Kumar has been granted anticipatory bail vide order dated 12.06.2018 in Cr. Misc. No. 31352 of 2018 and Sushil Kumar has been granted regular bail vide order dated 18.06.2018 in Cr. Misc. No. 32230 of 2018.

Considering the aforesaid, the petitioner, named

Patna High Court Cr.Misc. No.36175 of 2018 (2) dt.28-06-2018 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Kaimur at Bhabua in connection with Excise Case No. 372 of 2018 (Durgawati P.S. Case No. 146 of 2018).
