JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Phulpras P.S. Case No. 15 of 2015 registered under Sections 147, 148, 149, 323, 324, 379, 307 and 504 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that co-accused Shyam Sundar Das, Akhilesh Kumar Das, Mohan Das, Ghuran Das, Sivtosh Das and Sri Prasad Das against whom there is identical allegation have already been granted pre-arrest bail by the court below vide order dated

Patna High Court Cr.Misc. No.58690 of 2017 (2) dt.12-12-2017 30.09.2015 in A.B.P. No.595 of 2015/20 of 2015. He submitted that there is a case and counter case and the injuries sustained by the members of the prosecution party were found simple in nature.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. However, he conceded that some of the co-accused have already been granted pre-arrest bail by the court below itself. Considering the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur, Madhubani in connection with Phulpras P.S. Case No. 15 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
