The petitioner seeks regular bail in connection with Daudnagar P.S. Case No.196 of 2016 instituted for the offences under Section 30(k) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 396 bottles of English wine and 90 pouches of country made liquor from a Marshal vehicle.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated and the said vehicle from which the alleged recovery has been made has already been sold by him earlier. It is further submitted that the petitioner has got a

Patna High Court Cr.Misc. No.60897 of 2017 (2) dt.21-12-2017 2/2 clean antecedent and is in custody since 10.11.2017. Considering the nature of accusation, the period of custody already undergone and the fact that he has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum-Special Judge (Excise) Act, Aurangabad in connection with Daudnagar P.S. Case No.196 of 2016.
