The petitioner is accused in connection with Buddha Colony P.S. Case No. 300 of 2017, registered under Sections 420, 406, 120B, 384 and 506/34 of the Indian Penal Code.

The accusation is that, in course of morning walk, informant, Rajiv Kumar, met to this petitioner and asked the informant to invest Rs.10,00,000/- to 15,00,000/- to earn Rs.1 crore within few days. Accordingly, petitioner gave Rs. 10,00,000/- on different dates. Later on, informant came to know that petitioner and his associates are engaged in gambling. Thereafter, petitioner again asked the

informant to invest Rs.20,00,000/- to 25,00,000/- saying that he will earn one crore within month, but the informant showed his inability to expend the said money. Thereafter, petitioner got the thumb impression and signature on plain stamp papers of informant. Later on, petitioner informed to informant that he got prepared the agreement to sale regarding his flat showing the advance of Rs.50,00,000/-. Learned counsel for the petitioner submits that, while it is alleged in the F.I.R. that cheque of Rs.1,00,000/- of H.D.F.C. Bank was given by the informant to the petitioner, but in whole case diary, there is no description of cheque number and also crediting the money in the account of the petitioner. It is further submitted that petitioner has no criminal antecedent and he is in custody since 31.08.2017.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Patna, in connection with Buddha Colony P.S. Case No. 300 of 2017. Out of two sureties, one
