ANJANA MISHRA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are in custody since 20.03.2017 in connection with S.T. No.345 of 2017, arising out of Rajoun P.S. Case No.227 of 2016, registered for the offence under Sections 147, 149, 341, 323, 324, 307, 302 of the Indian Penal Code. Learned counsel for the petitioners submits that initially F.I.R. under Section 307 of the I.P.C. was filed belatedly after seven days of the occurrence and thereafter, when the lady died after 45 days, Section 302 I.P.C. has also been included. Learned counsel for the petitioners, however, submits that the victim lady died of a fall and she was treated at
Patna High Court Cr.Misc. No.32085 of 2018 (3) dt.28-06-2018 2/2 the hospital. Thus, initially the story of attack was developed and the F.I.R. has been lodged after seven days of the occurrence.
Having considered the entire facts and circumstances of the case and also because there was only one other criminal antecedent against the petitioners, let both the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Banka, in connection with S.T. No.345 of 2017, arising out of Rajoun P.S. Case No.227 of 2016.
