JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioner apprehends his arrest in connection with Makhdumpur (Tehta) P.S.Case No. 73 of 2018 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 342, 332, 353, 307, 427, 435 and 511 of the Indian Penal Code. Allegation against the petitioner is that he instigated the accused persons to assault the police personnel and police personal fled away from the place of occurrence.

Submission of learned counsel for the petitioner is that one person has died due to negligent driving and petitioner along with others was proceeding towards the truck and, as such, he has been made accused in this case.

Having heard both sides and from perusal of FIR it

Patna High Court Cr.Misc. No.32442 of 2018 (2) dt.28-06-2018 2/2 appears petitioner along with others instigated the accused persons to assault the police personnel and police fled away from the place of occurrence, considering the same I am not inclined to grant privilege of anticipatory bail to the petitioner. Petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and disposed of on the same day, if possible.
