JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody, seek bail in Case No. 2 of 2017 registered under Annexcure II of Wild Animal Protection Act, 1972.

The allegation in brief is that the petitioners were apprehended carrying away 57 tortoise in a bag from bogie of a train. Learned Counsel for the petitioners submits that they have been apprehended on suspicion on the train while traveling, are in custody since 27.7.2017, however charge-sheet has been submitted in this case and the petitioners have no criminal antecedent. Having considered the said facts and circumstances, the petitioners, namely Biru Kasodan @ Veer Bahadur and Sahib Khan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM IInd, Naugachia, Bhagalpur in connection with Case No. 2 of 2017.
