Petitioner seeks bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.
The statement of the victim recorded under Section 164 Cr.P.C. at Annexure-2 would reveal that she had gone along with co-accused, Kailash. She never made any protest, though she was staying at the railway station for a long time. Thereafter, she went to Kolkata, where the petitioner was also there. From Kolkata, co-accused, Kailash took her to Gujarat. Considering the statement of the victim, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.31799 of 2018 (3) dt.03-07-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Katoria Police Station Case No.178 of 2017, subject to the condition that both the bailors shall be resident of the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
