ANJANA MISHRA ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.05.2017 in connection with Tarabari P.S. Case No.84 of 2015 corresponding to Spl. Case No.22 of 2015 registered for the offence under Section 376 of the Indian Penal Code and Section 3/4 of the POCSO Act, pending in the court of the learned 1st Additional Sessions Cum Spl. Judge, Araria Learned counsel for the petitioner submits that the case is false and fabricated.

However, taking into consideration the fact that the victim girl (prosecutrix) in her statement has specifically named the petitioner, I am not inclined to grant regular bail to the petitioner. It is, accordingly, dismissed.
