ANJANA MISHRA ORAL ORDER 03-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is in custody since 20.03.2018 in connection with Kanti P,S. Case No. 563 of 2017 registered under Sections 413 and 414 of the Indian Penal Code.

The learned counsel for the petitioner submits that admittedly the recovery was from Amar Kumar Pandit and not this petitioner. It is further submitted that the brother has taken the name of this petitioner and from the conscious possession of this petitioner, nothing has been recovered.

In view of the aforementioned facts and circumstances that the petitioner has got no criminal antecedent except one case on which he is on bail, let the petitioner, above named, is directed to

Patna High Court Cr.Misc. No.33211 of 2018 (3) dt.03-07-2018 2/2 be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, West Muzaffarpur in connection with Kanti P.S.
