2. The petitioner seeks bail in connection with Kuchaikote P.S. Case No. 298/2023 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, 45 liters of illicit liquor has been recovered from the Bolero Vehicle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He further submits that petitioner is ready to donate Rs. 10,000/- (Rupees Ten Thousand Only) in some charitable organization without prejudice to his case and

5. Learned APP has vehemently opposed the prayer of bail.

6. Considering the period of custody and recovery of illicit liquor, this application for bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, IV cum Exclusive Spl. Excise Court II, Gopalganj in connection with Kuchaikote P.S. Case No. 298/2023.

8. The bail bond of the petitioner shall be accepted only after the deposit of Rs. 10,000/- (Rupees Ten Thousand Only) in Ram Krishna Mission Ashram, Chapra, Saran and produces the receipt of the same and after verifying the genuineness of the receipt, the petitioner shall be released.
