The petitioner seeks regular bail in connection with Jandaha P.S. Case No.35 of 2018 for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in FIR and he is in custody since 03.03.2018, till date no T.I.P. has been conducted to establish his identity with the alleged occurrence. It is further submitted that no stolen article has been recovered from the possession of the petitioner and that the similarly situated accused persons have been granted regular bail by a Coordinate Bench of this Court vide order dated 29.05.2018 in Criminal Miscellaneous No.26683 of 2018.

Patna High Court Cr.Misc. No.32356 of 2018 (2) dt.12-06-2018 2/2 Learned APP for the State is present, however, he has not disputed the submission that the petitioner is similarly situated to the petitioner in Criminal Miscellaneous No.26683 of 2018. Considering the facts and circumstance of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Vaishali at Hajipur, in connection with Jandaha P.S. Case No.35 of 2018 subject to the conditions as laid down under Section 437(3) Cr.P.C.
