The petitioner is in custody since 13.02.2018 in connection with Nimchak Bathani P.S. Case No. 16 of 2018 registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-b) A, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that there was no recovery from conscious possession of the petitioner rather the alleged recoveries were made from joint house in which other family members also reside.

Considering the fact that the petitioner has only one other case and has been in custody since 13.02.2018, let the petitioner, above named, be released on bail on his furnishing bail
