Petitioners apprehend their arrest in connection with Barbigha P.S. Case No. 80 of 2016, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act.
Learned counsel for the petitioners has submitted that the petitioners are innocent and have not committed any offence. In fact, there is allegation of alleged recovery of 20-20 liters of country-made liquor from the house of the petitioners but nothing has been recovered from the conscious possession of the petitioners. There petitioners are not involved in dealing with
Patna High Court Cr.Misc. No.32466 of 2018 (2) dt.06-06-2018 2/2 illegal wine. Hence, the petitioners deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Ist-Additional District and Sessions Judge, Sheikhpura in connection with Barbigha P.S. Case No. 80 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
