JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 14-06-2018 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner is seeking regular bail in Mansi P.S. Case No. 63/2018, G.R. No. 844/18, registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. It is submitted on behalf of the petitioner that he is neither driver nor owner of the vehicle in question from which the alleged illicit liquor has been seized by police. Learned counsel submits that this petitioner was an innocent passenger who had been travelling without being aware of the illicit liquor kept beneath the seat of the tempo.

Learned A.P.P for the State is present.

Considering the facts and circumstance of the case whereunder the petitioner is neither owner nor driver of the

No.33931 of 2018 (2) dt.14-06-2018 2/2 vehicle and further submission that this petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, III Cum Special Judge, Excise, Khagaria, in connection with Mansi P.S. Case No. 63/2018, G.R. No. 844/2018 subject to the conditions as laid down under Section 437(3) Cr.P.C.
