Petitioners are in custody in connection with Bihta P.S. Case No. 283 of 2018 giving rise to Special Case No. 2668 of 2018 for offence under Section 30(a)/37(b) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel submits that petitioner has no criminal antecedent. He further submits that police has conducted raid and recovered country made wine near bank of Son river, west of Mauddhi village. Referring to the aforesaid circumstances that nothing was recovered from the possession of the petitioners and he submits that the petitioner deserves bail.
Patna High Court Cr.Misc. No.33161 of 2018(2) dt.05-06-2018 2/2 Considering the totality of the fact and situation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Bihta P.S. Case No. 283 of 2018, Special Case No. 2668 of 2018.
