This application for grant of regular bail arises out of Barh P.S. Case No.213 of 2019, registered for the offence punishable under Sections 341, 323, 324, 326, 307 and 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code.
There is allegation in the First Information Report against the accused persons of assault on the informant's mother-in-law. When others came in her rescue, they were also assaulted. The mother-in-law of the informant succumbed to the injuries.
Learned counsel appearing on behalf of the petitioner has submitted that even as per the First Information Report, the iron rod blow in the head of the informant's motherin-law was given by co-accused Nandu Yadav. It is alleged
Patna High Court CR. MISC. No.62803 of 2019(3) dt.05-03-2020 2/2 against this petitioner that he had assaulted brothers of the informant's husband with the butt of the pistol and khanti. Learned counsel appearing on behalf of the petitioner has submitted that the injury, allegedly caused by him, have been found to be simple in nature. He has further submitted that if the allegation that the petitioner had hit the victims with the butt of the pistol is treated to be correct, no allegation of intention to kill is made out against the petitioner. I find substance in the submission made on behalf of the petitioner.
Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Barh, Patna, in Barh P.S. Case No. 213 of 2019.
