JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Dawath P.S. Case No. 36 of 2018 for the offences under Sections 406,420,467,468 and 471 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a man of clean antecedent. Referring to the allegation made in the instant case, he submits that there is allegation that petitioner has enrolled the candidates for I.T.I. Courses although he was not authorized as he had no such permission to run I.T.I. Course institution. He further submits that other candidates have been accommodated in other institutions on account of the fact that the petitioner was not granted permission to run the I.T.I Course institution. Patna High Court Cr.Misc. No.33301 of 2018(2) dt.07-06-2018 2/2 submits that there is allegation that the petitioner has realized 30,000/- in the name of enrollment in I.T.I Courses from the informant. Counsel submits that the petitioner may be permitted to deposit Rs. 30,000/- before the Court below so that the monetary interest of the informant is taken care of. Considering the fact that the petitioner has no criminal antecedent, he has remained in jail since 27.04.2018 and he has offered that he will deposition 30,000/- in the Court below, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bikramganj in connection with Dawath P.S. Case No. 36 of 2018, subject to the deposit of Rs. 30,000/- before the Court below.
