JUSTICE ARUN KUMAR ORAL ORDER 27-06-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State.

Petitioner, already in custody since 12.3.2018 seeks bail in Kalyanpur PS Case No. 82 of 2017, registered under Sections 147, 148, 149, 323, 379, 307, 504 and 506/34 of the IPC. The allegation in brief is that due to land dispute all the accused persons turned up and assaulted the informant and others and the allegation against the petitioner is that he gave dab blow on the head of the informant.

Learned Counsel for the petitioner submits that the allegation is false, dab is a sharp cutting weapon but only lacerated wound was found over head of the informant and that too simple in nature.

Having considered the said facts and circumstances, the petitioner Lalita Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 9th ACJM East Champaran at Motihari in connection with Kalyanpur PS Case No. 82 of 2017.
