====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 14-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Palanwa P.S. Case No.84 of 2017 registered under Sections 304(B), 201 and 120(B) of the Indian Penal Code.

The accusation is of sprinkling the acid at the daughter of the complainant/informant on 21.04.2017 for non fulfillment of the demand of motorcycle in dowry by her husband and other in-laws, who died in course of treatment on 04.05.2017 at Rahmania Hospital. At that time, the complainant/informant was restrained to lodge the case saying that her daughter would recover her health.

Learned counsel for the petitioners submits that the petitioners

Patna High Court Cr.Misc. No.60873 of 2017 (2) dt.14-12-2017 2/2 are father-in-law, mother-in-law and unmarried sister-in-law of the deceased, the daughter of the complainant/informant. In fact, the deceased, the daughter of the complainant/informant, sustained burn injury due to blast of the stove at the time of coking the meal and she was rushed to the hospital where she died after 59 days and her postmortem was done in presence of the complainant/informant but with an ulterior motive the complainant/informant lodged Complaint Case No.120(C) of 2017, which is the basis of the present F.I.R. The petitioners have no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Palanwa P.S. Case No.84 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
