The petitioner is in custody since 30.02.2018 in connection with Rail P.S. Siwan Case No. 28 of 2018 for the offence registered under Sections 379/34 of the Indian Penal Code.

Leaned counsel for the petitioner submits that his name has surfaced on the basis of the confessional statement made by the co-accused that he had stolen the mobile of the informant and the same had been given to the present petitioner. It is further submitted that the stolen mobile has not been recovered from the possession of the petitioner.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the

No.33634 of 2018 (3) dt.11-07-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate (Railway) Sonepur (Saran) in connection with Rail P.S. Siwan Case No. 28 of 2018.
