JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-07-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Kudhani PS case no. 497 of 2017 instituted for the offences punishable under Section 395 of Indian Penal Code. The allegation is regarding unknown persons having broken the ATM and taken out money from the ATM. The learned counsel for the petitioners submits that the petitioners are non-FIR named accused persons, no recovery has been made from their possession, no T.I. parade has been held and they are having fair antecedents except one case, in which they are on bail. It is further submitted that the petitioners are

Patna High Court Cr.Misc. No.33776 of 2018 (3) dt.23-07-2018 2/2 languishing in custody since 24.01.2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-cum-Sub Judge III, Muzaffarpur in connection with Kudhni PS case no. 497 of 2017.
