1. Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in Mirganj P. S. Case No.05 of 2021 registered for the offences punishable under Sections 366(A), 323 and 376 of the Indian Penal Code and Section 8 of the POCSO Act, but chargesheet has been submitted under Sections 494, 498(A) and 34 of the I.P.C. and Sections 3 and 4 of the D. P. Act.
3. The learned counsel appearing on behalf of the informant, at the outset, submits that he has instructions not to oppose the anticipatory bail application of the petitioner as the dispute in between the petitioner and the informant stands
Patna High Court CR. MISC. No.69967 of 2023(4) dt.09-05-2024 2/2 resolved amicably.
4. Considering the submissions made by the learned counsel for the informant, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXVI, Gopalganj in connection with Mirganj P. S. Case No.05 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
5. The application stands allowed.
