The petitioner, in the present case, is seeking regular bail in connection with Andharathadi P.S. Case No. 02 of 2018, registered for offences alleged under Sections 364, 365/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is not named in F.I.R., the victim has made statements U/s 164 of the Code of Criminal Procedure in which he has not named this petitioner and the person named therein has already been granted regular bail by a co-ordinate bench of this Court vide order dated 10.04.2018 passed in Cr. Misc. No. 19489 / 2018 (Annexure-3). Learned APP for the State is present.

In the facts and circumstances of the case wherein the name
