JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Trial No. 2979 of 2019, arising out of Complaint Case No. C- 266 of 2018, disclosing offences under Sections 498A, 324, 323, 354B, 506 and 120B of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. As per complaint case, there is allegation of demand and torture against the petitioner, who happens to be the husband of the complainant.

Submission of learned counsel for the petitioner is that though there is allegation against him of remarriage but he is still ready to keep her with dignity and care and even he is ready for one time settlement, whichever is suitable to the

Heard learned APP as well as learned counsel for the complainant, who has also submitted that she is ready for one tile settlement.

In such view of the matter, this application is disposed of with a direction to the petitioner to surrender before the learned court below on 15.11.2019 and on that day the opposite party no.2 shall also remain present in the Court. The learned court below on their appearance shall release the petitioner on provisional bail for a period of six months and referred the matter to the District Mediation Center, as there is a submission of both the parties for one time settlement or any other amicable settlement, in which both the parties shall co-operate. Once mediator's report is available, considering the same and also considering the conduct of parties, he will pass an appropriate order confirming the bail bonds of the petitioner or any other order or orders, which may deem fit and proper.
