Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307/353/332/333/427/504/379/511 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that three sand loaded tractors were intercepted by the informant and when seizure list was being prepared, suddenly all the FIR named accused persons and 10 to 15 other unknown accused persons surrounded them and pelted stones on the police party.

No.70878 of 2022(2) dt.21-03-2023 2/2 Learned counsel appearing for the petitioners submits that the petitioners are neither drivers nor they are owner of those tractors and there is general and omnibus allegation against them and no specific overt act has been alleged against them and they have been made accused in this case on suspicion. Petitioners have got no criminal antecedent. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Jamui in Laxmipur/Gidhor Police Station Case No. 316 of 2022, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
