JUSTICE ARUN KUMAR ORAL ORDER 26-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Hajipur P.S.Case No. 857 of 2017 registered under Sections 365 and 366A/34 of the Indian penal Code. Allegation in brief is that one Ramesh Kumar is suspected to have kidnapped the daughter of the informant, later on, girl was recovered and in her statement recorded under Section 164 Cr.P.C., has named Ramesh Kumar, Chandan Kumar, Raj Nandan and Dipak Kumar, who had kidnapped her and brought to her Haryana and there Ramesh forcibly established physical relationship and later one, brought back her at the Fatuha railway station where she found this petitioner also present there and they went leaving her near Nagar Police Station. Patna High Court Cr.Misc. No.34192 of 2018(2) dt.26-06-2018 2/2 accused Ramesh Kumar as such he has been implicated in this case and the allegation of kidnapping is against Ramesh Kumar and his friends and not against this petitioner. Having considered the aforesaid facts and circumstances, the petitioner, namely , Congress Prasad, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 857 of 2017.
