====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 The petitioner seeks regular bail in connection with Economi Offences P.S. Case No. 13 of 2018, registered for offences punishable under Sections 8/20 (b)(ii)( c)/25/29 of the N.D.P.S. Act.

Allegation is of recovery of 55.5 kg of ganja from the car and petitioner and other accused persons were arrested there and it further appears that accused persons disclosed that ganja belongs to petitioner.

It has been submitted on behalf of the petitioner that he was only a passenger in the car and has falsely been implicated in this case and he has been in judicial custody for more than a year.

Patna High Court CR. MISC. No.68049 of 2019(4) dt.04-02-2020 2/2 Heard learned A.P.P. as well as learned senior counsel appearing on behalf of the Economic Offence Unit. They have opposed the prayer for bail and submitted that recovery of ganja is more than commercial quantity and petitioner was arrested on spot and other incriminating materials have also come against the petitioner during investigation.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. However, since the petitioner has been in custody, learned Trial Court is directed to expedite the Trial. This application is accordingly dismissed.
