JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, in the present case, is seeking regular bail in connection with Arer P.S. Case No.53 of 2018 registered for offences alleged under Section 290 of the I.P.C. and Section 37(C) of the Bihar Prohibition and Excise Act, 2016. It is submitted on behalf of the petitioner that there is no recovery of illicit liquor from the possession of the petitioner. The allegation is that he was found in drunken condition. Learned counsel submits that the petitioner is a social worker and being a member of C.P.I. he has been raising objection against the Government Officials including the police personnel due to which he has falsely been implicated in the present case. The petitioner is

Patna High Court Cr.Misc. No.34165 of 2018 (2) dt.12-06-2018 in custody since 29.04.2018. It is further submitted that even though there are some criminal cases registered against the petitioner, but those cases are not under the provisions of the Bihar Prohibition and Excise Act, 2016.

Learned A.P.P. for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case whereunder nothing has been recovered from the possession of the petitioner and the only allegation is that he was found in drunken condition, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Session Judge-II -cum- Special Judge Excise Act, Madhubani, in connection with Arer P.S. Case No. 53 of 2018, subject to the conditions under Section 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
