The petitioner, in the present case, is seeking regular bail in connection with C2/263/18, registered for offences alleged under Section 30 (A) Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the recovery of 54 liters Nepali Liquor is from a motorcycle which does not belong to the petitioner. It is submitted that the petitioner has no criminal history.
Learned APP for the State is present.
Considering the facts and circumstance of the case
Patna High Court Cr.Misc. No.34284 of 2018 (2) dt.14-06-2018 whereunder neither the motorcycle belongs to the petitioner nor the illicit liquor seems to have been seized from the conscious possession of the petitioner as also that the petitioner has no criminal history, let the petitioner above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II -cum- Special Judge (Excise), Sitamarhi, in connection with C2/263/18, subject to the conditions U/S 437(3) Cr.P.C.
