The petitioner is in custody in connection with Special Case No. 7027 of 2019 arising out of Kadamkuan P.S. Case No. 508 of 2019 for the offenses under Sections 37 (b) (c) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Allegation against the petitioner in the instant case is that he was found positive during breath analyzer test. The petitioner is in custody since 06.08.2019.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on
